預告登記逃避奢侈稅 國稅局破解

奢侈稅實施二年，利用人頭、假信託等方式逃漏稅的手法層出不窮，其中，買賣雙方採預告登記方式以確保產權，等原賣方持有該房地期間超過二年後，再行辦理移轉登記，這種預告登記的手法，已遭國稅局破解，國稅局調閱地籍資料，從辦理預告登記的所有權人中，過濾出日後實際過戶的賣方，課以2.5倍的漏稅罰鍰。

中區國稅局表示，透過濾告登記規避奢侈稅的民眾，多半急於脫手變現，又不希望繳交10%奢侈稅，於是聽從土地代書建議，將不動產預告登記給買方，暫不辦理過戶給賣方

中區國稅局表示，今年五、六月從地政機關辦理預告登記民眾中撈出檔案，從預告登記登記原因代碼中，把一些正當原因（不動產保全）排除，過濾出可疑案例

財政部為杜絕迂迴規避手法，已於今年七月發布修正稅務違章案件裁罰金額或倍數參考表，處罰倍數已提高為2.5倍，民眾切勿心存僥倖而觸法受罰。
