洪案偵結 軍方召開記者會

最高軍事法院檢察署、高等軍事法院檢察署、北部地方軍事法院檢察署上午9時召開記者會，對外說明「洪仲丘下士死亡案」偵結報告。針對國防部軍檢軍事檢察署於今(31)日早上偵結起訴，公民1985行動聯盟指出，若起訴是為了趕在8/3凱道遊行前結案，本單位表達強烈憤怒之意。
公民1985行動聯盟聲明指出，軍檢察署在未完成全部調查、了解犯案動機前，草率偵結起訴，公民1985行動聯盟表達遺憾與憤怒之意。過去三周，軍檢在偵查時不斷透過曹檢察長對外放話，除言行舉止有如跳樑小丑，對於案情說詞前後矛盾外；今日軍檢又在真相未白、未偵查出犯案動機、以及立法院修法之際前草率偵結起訴。軍事檢察體系身為國家司法體制及國防的一環，種種行為已讓人民對於軍事檢察體系失去耐心及信任。我方強烈主張，若軍事司法體系已不合乎台灣社會現況，人員素質未能隨國家司法改革提升，應被廢除。相關案件應回歸一般司法體系偵查、審理。
公民1985行動聯盟認為，對於起訴內容，深感不以為然。全案竟然只肇因於一個中士的凌虐及幾位禁閉室幹部的業務疏失，對於其他簽發禁閉的高官的犯意聯絡及犯案動機交代不明，顯然有違經驗法則。『只辦基層小兵、縱放高層大官』，完全違反楊副部長之前對於嚴懲兇手的承諾。
公民1985行動聯盟說，軍事檢察署對於何江忠、范佐憲及陳以仁的犯案動機無所交代，並故意暗指洪仲丘竄改體測成績及不願意背值星，讓『很多人』討厭，但隨後又說明很多人是指范佐憲及陳以仁。此種說法不禁讓人懷疑軍檢辦案早有預設立場，且讓人起疑是否有袒護之嫌。
公民1985行動聯盟表示，對於TVBS報導，軍檢起訴是為了趕在8/3凱道遊行前結案，若報導屬實，本單位表達強烈憤怒之意。公民上街遊行為基本權益，軍檢依法公正偵辦案件更是國家司法權的表彰。國防部以此理由草率偵結本案，不僅藐視憲法賦予人民的基本權益，更充分顯示軍檢無法善盡國家司法權賦予的責任。 (接下一頁)
