要求勞工颱風天出勤 雇主應給津貼或協助

蘇力颱風威力直逼台灣，新北市勞工局今天表示，如果勞工因為颱風假而未出勤，雇主對勞工不得有曠工、遲到，或事後強迫勞工補工、扣全勤及影響考績，甚至解僱等種種不利的處分；若雇主強迫勞工把颱風假的休假以其他假別處理，像是強迫勞工排定特別休假，雇主就涉嫌違反勞基法第38條規定。而雇主如果因為業務性質需要，要求勞工要在颱風假出勤，就要給予適當協助，像是提供交通工具或津貼等。

至於勞工於颱風假未出勤，工資如何給付，勞工局長謝政達表示，依照相關規定，如果勞工工作地、居住地或正常上下班必經途中，轄區首長通報停止辦公，勞工就可以不出勤，當日工資如何給付，得由勞資雙方自行協商；另外勞工如果應雇主要求而出勤，雇主除了要給當日工資外，勞工局建議雇主，應該本於體恤勞工的立場，加給工資。而萬一勞工在颱風天上下班途中或工作過程中發生意外事故，雇主仍然必須負起職災補償責任。
