露天拍賣二手書退換貨

請問各位熟悉法律的大大~

前幾天在露天拍賣買了一套漫畫，在網頁上賣家標示"全新"，
在詢問貨品狀況時，賣家也說"沒什麼發黃與黃斑"，
在網頁上也未標明漫畫上有蓋店章。

收到物品時，三分之二以上都有發皇與黃斑的情況，不是全新品!
而且幾乎每本側面都有蓋上店章，
請問這樣賣家算不算有詐欺嫌疑呢??

網拍的二手書真的沒有七天鑑賞期嗎??

詢問賣家能不能退貨，賣家說只退我五分之四的錢，
這樣合法嗎??

拜託大家幫我解答>"<....
